The Court of Appeal has upheld Joseph Kyalo’s 25-year sentence, rejecting his argument that the killing followed a spontaneous drunken fight.
Judges ruled that four eyewitnesses remained reliable despite admitting they had been drinking and were intoxicated as the incident happened.
The case began on April 16, 2018, at Kikunuani Market in Kathiani Sub-County, Machakos County, where Kyalo operated Club Digital.

He invited patrons from a nearby miraa base to the birthday celebration. The club belonged to his brother, Muli.
One of the guests, Paul Kiio, was already drunk when he joined the group at the Home Boys miraa base before being invited to the birthday party at the club. The group later moved to the bar, where they continued drinking alcohol, with Kyalo serving Kiio some beverages before leaving briefly.
Trouble began after Kyalo locked the club and later confronted patrons over an opened padlock.
The judges said he then confronted Kiio, demanding a pistol he claimed had been used to threaten his father.
Kiio denied having a pistol. Witnesses said Kyalo then slapped and kicked him before repeatedly hitting his head with empty beer bottles.
Samuel Makani, one of four eyewitnesses, said Kyalo pushed Kiio down before another reveller joined the assault.
