4. Age Access and Eligibility

Jukwaa is not intended for unsupervised use by children. Users must be at least 13 years old to create or use an account, unless access is provided through a parent, guardian, school, institution, or approved educational arrangement. Users below 18 may only access age-appropriate content and should do so under parental or guardian supervision.

Jukwaa may restrict the following to users aged 18 years and above:

  • mature content;
  • restricted content;
  • sensitive content;

  • any content or service unsuitable for minors.

Users must not misrepresent their age. Where Jukwaa reasonably believes that a user has provided false age information, Jukwaa may restrict access, request verification, disable the account, remove content, block purchases, suspend payment access, or take other protective action.

5. Educational Content and Minors

Jukwaa may include education content for early learning, primary, secondary, tertiary, professional, or general learning audiences. Education content intended for minors must be age-appropriate, safe, lawful, non-sexualised, non-exploitative, non-harmful, respectful, clearly labelled by age group, class, level, topic, or audience, free from grooming, manipulation, harassment, or unsafe contact, and free from misleading, harmful, or exploitative commercial claims.

Education content may be accessed by minors where appropriate, but children should do so under parental, guardian, teacher, school, or institutional supervision. Creators publishing educational content for minors may be required to provide additional information, permissions, or assurances.

6. Account Registration

Some parts of Jukwaa may be accessed without creating an account. To access purchases, subscriptions, uploads, creator tools, paid content, wallet features, comments, downloads, or payouts, you may be required to create an account. You agree to provide accurate and up-to-date information, truthful age information, keep login credentials secure, not share your account with unauthorised persons, notify Jukwaa immediately if you suspect unauthorised access, and accept responsibility for all activities under your account.

Jukwaa may suspend, restrict, or terminate your account if we reasonably believe it has been used for fraud, piracy, impersonation, unlawful content, payment abuse, harassment, misleading activity, child safety risk, age misrepresentation, or breach of these Terms.

7. User Conduct

You agree not to use Jukwaa to violate any Kenyan law or applicable international law; upload, distribute, sell, or promote unlawful content; infringe copyright, trademarks, image rights, privacy rights, publicity rights, performer rights, moral rights, or other third-party rights; upload pirated, stolen, leaked, copied, or unauthorised content; impersonate another person, creator, organisation, brand, public institution, payment provider, or government body; mislead users; engage in fraud, money laundering, terrorist financing, bribery, corruption, or suspicious transactions; distribute malware, phishing links, or harmful code; scrape or extract platform data without written permission; interfere with platform security or availability; harass, threaten, abuse, defame, stalk, exploit, bully, or intimidate others; post hateful, discriminatory, sexually exploitative, violent, harmful, or prohibited material; upload content that sexualises, exploits, endangers, grooms, abuses, or harms minors; promote unlicensed gambling, pyramid schemes, scams, counterfeit goods, illegal financial services, or prohibited products; manipulate views, purchases, ratings, comments, payouts, referrals, subscriptions, or engagement metrics; bypass payment systems, platform commissions, access controls, age gates, moderation tools, anti-piracy systems, or security controls; or redirect users to off-platform payments for content listed or monetised on Jukwaa.

Jukwaa reserves the right to remove content, restrict access, suspend accounts, reverse transactions, delay payouts, disable comments, limit purchases, or report activity to relevant authorities where necessary.

8. Creator Content and Ownership

Creators retain ownership of the intellectual property rights in content they upload unless otherwise agreed in writing. By uploading, submitting, publishing, or listing content on Jukwaa, you grant Creative Digital Lab Limited and Jukwaa a non-exclusive, worldwide, royalty-free, sublicensable, transferable licence to host, store, reproduce, encode, process, display, distribute, promote, market, transmit, make available, protect, moderate, analyse, and otherwise use the content for operating, improving, promoting, securing, and providing the Platform.

This licence allows Jukwaa to display your content; make it available to users who purchase, subscribe, rent, stream, download, or otherwise access it; create previews, thumbnails, trailers, cover images, excerpts, snippets, captions, summaries, and promotional materials; process content for technical compatibility, compression, security, delivery, moderation, accessibility, and discovery; promote your creator page or content; use content metadata for search, discovery, recommendation, analytics, and platform improvement; and enforce anti-piracy, takedown, child safety, payment, and moderation rights where authorised. This licence does not transfer ownership to Jukwaa or Creative Digital Lab Limited.

9. Creator Representations and Warranties

If you upload, publish, sell, or monetise content on Jukwaa, you confirm that you own the content or have valid rights, licences, permissions, and releases; the content does not infringe third-party rights; you have obtained all necessary consents from performers, actors, writers, producers, photographers, musicians, contributors, interviewees, minors’ parents or guardians, schools, institutions, and participants; you have cleared all music, footage, artwork, scripts, images, logos, archive material, third-party clips, and third-party materials; your content is not pirated, stolen, leaked, defamatory, unlawful, harmful, exploitative, or prohibited; your content complies with the Prohibited Content Policy and Child Safety Policy; your content complies with applicable laws, classification rules, advertising rules, consumer protection rules, data protection rules, child protection obligations, and payment provider requirements; you will not use Jukwaa for money laundering, proceeds of crime, unlawful payments, or fraud; and your content is correctly classified.

Jukwaa may require supporting documentation including copyright ownership documents, licensing agreements, release forms, contracts, identity documents, business registration documents, tax details, bank details, mobile money details, parental consents, institutional authority letters, or proof of creator authority before approving or continuing monetisation.

10. Platform Rights Over Content

Jukwaa may review, moderate, approve, reject, remove, restrict, age-gate, demonetise, suspend, or disable access to content where we reasonably believe it violates these Terms or any Jukwaa policy; exposes Jukwaa, Creative Digital Lab Limited, payment providers, users, creators, minors, or partners to legal or regulatory risk; is unlawful, misleading, harmful, offensive, fraudulent, pirated, exploitative, or infringing; has been reported by a rights holder, regulator, payment provider, law enforcement agency, parent, guardian, school, institution, or affected person; may cause harm to children, users, vulnerable persons, public order, or platform integrity; or is misclassified, misleadingly labelled, or unsuitable. Jukwaa is not obligated to host, publish, promote, recommend, or monetise any content.

11. Child Safety and Protection of Minors

Jukwaa has zero tolerance for child sexual abuse material, sexual exploitation of minors, grooming, trafficking, harassment, bullying, doxxing, endangerment, harmful contact, or any content or activity that exploits, sexualises, targets, abuses, or harms minors.

You must not upload, publish, sell, distribute, comment on, request, link to, promote, purchase, download, save, share, or otherwise interact with content involving child sexual abuse material; sexual exploitation of minors; grooming; trafficking of children; sexualised images, videos, text, audio, drawings, animations, or AI-generated content involving minors; sexual conversations with minors; solicitation of minors; requests for nude or intimate images from minors; non-consensual sharing of images of minors; sexual deepfakes involving minors; coercion, blackmail, or extortion involving minors; bullying or harassment of minors; humiliation or shaming of minors; child endangerment; child abuse; self-harm or suicide encouragement targeting minors; dangerous challenges targeting minors; exposing minors’ private personal information; or content that places a child at risk of real-world harm.

Where Jukwaa detects or receives a credible report of child sexual abuse material or serious child safety risk, Jukwaa may remove or disable content immediately, suspend or terminate accounts, preserve relevant evidence where lawful, block related accounts/devices/payment methods/access credentials, notify hosting providers/payment providers/partners, and report to law enforcement, child protection bodies, regulators, or other competent authorities where appropriate. Users must not download, copy, forward, save, repost, or redistribute suspected child sexual abuse material. Report it immediately.

12. Age Gates, Content Classification, and Parental Controls

Jukwaa may apply age gates, content labels, parental guidance notices, category restrictions, warnings, moderation review, or access limitations to protect minors. Content may be classified as suitable for all audiences, educational, parental guidance recommended, teen appropriate, mature, restricted, 18+ only, or prohibited. Creators must accurately classify content during upload. Jukwaa may change a rating, restrict access, add warnings, disable comments, limit recommendations, or remove content where classification is inaccurate, misleading, unsafe, or harmful to minors.

Parents and guardians are encouraged to supervise minors using Jukwaa. Where technically available, Jukwaa may support or introduce age gates, restricted content warnings, content labels, safe-search features, disabled mature content access, account restrictions, purchase restrictions, reporting tools, parental review requests, limited access for education content, and removal requests for child personal data.

13. Payments, Wallets, and Minors

Users below 18 should not use paid services, wallet features, subscriptions, tips, donations, or creator monetisation tools without appropriate parental, guardian, or institutional authorisation. Jukwaa may restrict minors from purchasing mature content, topping up wallets, tipping creators, subscribing to creators, accessing paid adult-themed content, becoming monetised creators, receiving payouts, or using high-risk interactive features. Payments involving minors may be reviewed under the Payment Terms and Refund Policy.

14. Purchases, Payments, and Access to Paid Content

Jukwaa may allow users to purchase, rent, subscribe, donate, tip, top up a wallet, or otherwise pay for content or creator services. Payments may be processed through third-party payment providers, mobile money operators, banks, card processors, payment aggregators, settlement providers, or authorised partners. Methods may include M-PESA, PawaPay, Tingg/Cellulant, Paystack, card payments, bank payments, wallet balance, or other enabled methods.

By making a payment, you agree that you are authorised to use the payment method, payment information is accurate, third-party terms may apply, confirmation depends on providers, Jukwaa may delay or deny access where payment is pending/failed/reversed/disputed/suspicious/incomplete, charges and taxes may apply, and Jukwaa may correct wallet balances, payment records, access records, and creator earnings where errors, reversals, refunds, or fraud are identified. Jukwaa may refuse, cancel, reverse, or review any transaction suspected of fraud, error, abuse, illegal activity, payment-provider breach, refund abuse, chargeback abuse, child safety concern, prohibited content, or Terms violation.

15. Wallet Top-Ups and Wallet Balance

Jukwaa may allow users to top up a wallet balance for approved digital content, subscriptions, rentals, tips, creator support payments, or other enabled services. Unless required by law or approved by Jukwaa, wallet balances are not bank deposits, do not earn interest, are not transferable without approval, are not redeemable for cash except where permitted, may be subject to verification/fraud/refund/account review, and may be suspended where suspicious activity is detected. Jukwaa may correct wallet balances for errors, duplicate credits, failed settlement, reversals, chargebacks, refunds, fraud, or provider corrections.

16. Refunds

Refunds are governed by the Jukwaa Refund Policy. Unless otherwise stated or required by law, digital content purchases may be non-refundable once access has been granted, streaming has started, a download link has been issued, a file has been accessed, a wallet top-up has been credited and used, or a digital service has been delivered.

Refunds may be considered for duplicate payment, undelivered access due to platform error, unpaid wallet credit, content removed before access, subscription charged after confirmed cancellation, failed transaction with deducted funds, payment-provider reversible error, or legal requirement. Refunds may be denied where the user changed their mind, failed to read the description, had device/internet issues, breached Terms, attempted fraud/abuse/piracy/refund abuse/account sharing, or access was successfully provided.

17. Payouts to Creators

Creator payouts are governed by the Jukwaa Payout Policy. Creators may be eligible for payouts from sales, subscriptions, rentals, tips, donations, licensing, digital ticketing, or other monetisation models, subject to successful payments, platform commission, provider fees, taxes and withholding, refund windows, fraud checks, chargebacks, reversals, disputes, minimum thresholds, verification, compliance checks, agreement terms, rights verification, child safety checks, takedown review, and prohibited content review. Jukwaa may delay, withhold, reverse, or adjust payouts where there is suspected fraud, infringement, refund exposure, payment reversal, compliance risk, complaint, rights dispute, prohibited content issue, child safety issue, or breach.

18. Prohibited Content

You may not upload, publish, sell, promote, distribute, recommend, link to, or monetise prohibited content. Prohibited content includes pirated or unauthorised content; sexually exploitative content; child sexual abuse material; content that sexualises, exploits, endangers, grooms, or harms minors; hateful or discriminatory content; terrorist or extremist content; unlawful gambling or betting content; scams, pyramid schemes, or fraudulent investment promotions; counterfeit goods or services; unlicensed financial services; illegal drugs or controlled substances; weapons or arms trading; defamatory or malicious content; non-consensual intimate content; impersonation or misleading political/public-interest content; malware, hacking tools, phishing, or cybercrime material; doxxing or privacy-violating content; and harmful misinformation likely to create real-world harm. Jukwaa may remove prohibited content without prior notice.

19. Anti-Piracy and Content Protection

Jukwaa protects creators and rights holders from piracy, unauthorised copying, illegal downloads, account sharing, screen recording, re-uploading, redistribution, and commercial misuse. Jukwaa may use watermarking, logs, tracking, device/session controls, takedown notices, account suspension, legal notices, and cooperation with relevant parties.

20. Copyright Complaints and Takedown Requests

Include full name and contact details, proof of authority, identification and URL of content, description of rights or policy violated, supporting evidence, good-faith statement, and signature or authorised confirmation. Jukwaa may remove or restrict disputed content while reviewing a complaint. Creators may respond unless immediate removal is required due to legal, regulatory, safety, payment, child safety, privacy, or rights-holder risk.

21. User Comments, Reviews, and Community Features

Jukwaa may allow comments, reviews, ratings, discussions, reactions, or other community content. You are responsible for what you post. You must not post abusive, hateful, defamatory, threatening, harassing, false, misleading, spam, private personal information, private personal information of minors, unlawful manipulation, sexually explicit, exploitative, violent, grooming, solicitation, unsafe contact involving minors, infringing, payment circumvention, or off-platform payment content. Jukwaa may moderate, remove, hide, restrict, disable, or report community features and may disable comments on child-focused, education, sensitive, or minor-involving content.

22. AI, Uploaded Content, and Platform Improvement

By using Jukwaa, you acknowledge and agree that Jukwaa may process and use uploaded content, platform data, usage data, feedback, reports, and interaction data for legitimate Platform purposes, including providing and delivering the Platform, search and discovery, recommendations, user experience, creator tools, fraud/piracy/spam/abuse/prohibited-content detection, moderation and safety, payment/refund/payout workflows, technical performance, trend analysis, accessibility, translation, captions, classification, organisation, customer service, dispute resolution, legal compliance, payment-provider requirements, and platform policies.

This does not transfer ownership. Users and creators may request removal, restriction, opt-out, or exclusion from certain AI/data improvement uses where technically feasible and legally permitted. Jukwaa may continue essential processing for contract performance, payments, payouts, refunds, fraud prevention, anti-piracy, child safety, moderation, legal compliance, tax/accounting records, disputes, security, rights-holder claims, and official obligations.

23. Third-Party Services and Data Sharing
