Tech entrepreneur and blogger Ndiang’ui Kinyagia has been awarded Ksh5 million by the High Court after police violated his constitutional rights during a June 2025 raid at his home in Kinoo.

🇰🇪 Breaking It Down

Justice Patricia Nyaundi ruled on Tuesday, September 22, that police unlawfully entered Kinyagia’s residence and seized his belongings during the operation.

The court found that the raid violated his rights to privacy, property, dignity, personal security and freedom of movement, ordering the Director of Criminal Investigations and the Inspector General of Police to pay the Ksh5 million award.

Justice Nyaundi also barred the Director of Public Prosecutions (DPP) from prosecuting Kinyagia based on the investigations that led to the raid.

📌 What You Need to Know

The proceedings followed heightened scrutiny of Kinyagia’s social media posts linked to anti-government protests, including a timetable for planned demonstrations.

The case dates back to June 2025, when Kinyagia disappeared from his home after learning that detectives were looking for him.

His disappearance prompted concern from his family and the Law Society of Kenya (LSK), with allegations that suspected DCI officers had raided his home and taken his electronic devices without a court order.

Kinyagia later resurfaced at the Milimani Law Courts in July 2025, explaining that he had gone into hiding because he feared for his safety .

Subsequently, he asked the High Court to protect him from arrest as he prepared an affidavit concerning the circumstances surrounding his disappearance.

The court had earlier issued orders barring his arrest and later gave him time to provide an account of what had happened.
