The Public Procurement Regulatory Authority (PPRA) has formally closed its investigation into the Football Kenya Federation's (FKF) controversial insurance arrangement for the 2024 Africa Nations Championship (CHAN), citing a lack of jurisdiction.

🇰🇪 Breaking It Down

The announcement was made through documents seen by  Kenyans.co.ke  on June 22, stating that the closure would take place after determining that no Kenyan public funds were used in the procurement that brought the insurance company involved in the case on board.

“In light of the response provided, the Authority finds that public funds were not utilised in the subject procurement,” stated the notice in part.

“As such, the transaction is not governed by the Act, and the Authority has no jurisdiction to further investigate the concerns raised in the complaint. The Authority has therefore proceeded to close this matter.”

📌 What You Need to Know

PPRA had launched the probe following complaints about alleged irregular procurement, conflict of interest, and misapplication of funds tied to the CHAN 2024 insurance deal.

The regulator confirmed that, while FKF is not automatically classified as a public entity, its mandate applies whenever public funds are involved in any procurement activity by the federation.

Since FKF demonstrated the funds came exclusively from the Confederation of African Football (CAF) and were managed through a CAF-controlled account, PPRA concluded it had no legal ground to proceed.

FKF, in its response to PPRA dated June 8, argued that the procurement followed CAF's own guidelines and financial procedures throughout, with all funds provided by the government used in accordance with those guidelines.

“We have reviewed your response and noted the following: The procurement process for the CHAN 2024 insurance arrangements, under which the company involved was engaged, was undertaken within the framework of the CAF Procurement Guidelines and funded through a CAF-controlled account,” stated FKF.

Adding, “No public funds appropriated by Parliament, county governments, or any Kenyan public entity were utilised in the procurement process. All funds utilised originated from CAF and were administered in accordance with CAF’s financial and procurement procedures.”
