The Commission on Administrative Justice (CAJ) has ordered the Tana River County Government to release information relating to the Inuka Fund and referred the Acting County Secretary for possible prosecution over failure to comply with requests for information and defiance of official summons.

🇰🇪 Breaking It Down

In a decision aimed at enforcing transparency, accountability, and compliance with the Access to Information Act, 2016, the Commission directed the county government to provide the requested records within 21 days.

According to the Ombudsman, the matter arose from an application filed by the Tana River Civil Society Organisations Network, which sought detailed information on Inuka Fund disbursements for the 2019/2020 and 2020/2021 financial years.

The county government initially provided only a partial response and later failed to respond to a follow-up request seeking additional information.

📌 What You Need to Know

The civil society network subsequently lodged a review application with the Ombudsman, prompting an inquiry into the matter.

The Commission further stated that after receiving the application, it issued an Access to Information Notice requiring the County Government of Tana River to provide the requested information within seven days.

However, the county government neither responded to the notice nor supplied the information sought.

Following the lack of response, the Commission summoned the Acting County Secretary to appear before it on February 2, 2026.

According to the Office of the Ombudsman, the Acting County Secretary allegedly failed to attend the hearing and did not submit any response to the Commission.

Consequently, the Commission directed that the matter be forwarded to the Office of the Director of Public Prosecutions (ODPP) within 30 days for consideration and possible prosecution.
