📋 Breaking It Down
A High Court judge has declined to compel the Ethics and Anti-Corruption Commission (EACC) to produce the back-end architecture of the government payment system in a case seeking to recover Sh14.85 million allegedly paid for goods that were never supplied.
Justice B.M. Musyoki ruled that EACC could not be ordered to produce information that it had not been shown to possess or control, saying the Integrated Financial Management Information System (IFMIS) is managed by the National Treasury.
The judge was determining a notice by Jeremy Muiriria, who wanted EACC to produce what he described as the “architecture for IFMIS payment data structure for transactions”.
📌 What You Need to Know
Muiriria is among five defendants sued by EACC over Sh14,851,939.65 allegedly paid by the Nairobi City County Government to Mary Wanjiku Mwangi, trading as Keywharfinvestments, between July 21 and July 26, 2021.

EACC claims the money was paid for goods that were never supplied.
According to the commission, the payments were processed through IFMIS by public officers who did not verify the supporting procurement and delivery documents.
The defendants are accused of participating in the payments at different stages. Muiriria denied involvement in fraud, collusion or breach of duty.
His defence is that at the time of the disputed transactions, he had been transferred from the county government to Nairobi Metropolitan Services and did not have physical or operational access to his former office or IFMIS.
