The High Court has ordered the freezing of more than Ksh105 million held by two Kenyans in cryptocurrency and local bank accounts as part of an assets recovery case involving suspected proceeds of crime.

🇰🇪 Breaking It Down

The orders were issued by the Anti-Corruption and Economic Crimes Division following an application by the Assets Recovery Agency (ARA), which sought to preserve the assets pending investigations and further directions from the court.

According to documents seen by Kenyans.co.ke , the preserved assets comprise about Ksh97.3 million held in cryptocurrency through Binance (752,749.70 USDT, equivalent to USD752,749.70) and approximately Ksh7.8 million held in local bank accounts.

Justice Rose Ougo certified the matter as urgent and directed that it be heard ex parte before granting the preservation orders sought by the Assets Recovery Agency.

📌 What You Need to Know

The court barred any transactions involving the cryptocurrency wallets, including withdrawals, transfers or any other dealings until further orders are issued.

It also froze the funds held in the respondents' local bank accounts and extended the preservation orders to cover any interest, profits or other benefits that may accrue from the preserved assets.

"An Order be and is hereby issued prohibiting, enjoining, or restraining the Respondents from transacting, withdrawing, transferring, and/or dealing in any manner" with the specified cryptocurrency wallets, part of the court order states.

The preservation orders were issued under Sections 81 and 82 of the Proceeds of Crime and Anti-Money Laundering Act (POCAMLA), which allows courts to preserve assets suspected to be proceeds of crime pending investigations and the determination of a case.

The court documents, which have already been gazetted, indicate that the cryptocurrency holdings account for the bulk of the frozen assets, while the remainder is held in local bank accounts.

The court further directed that the preservation orders extend to any interests, profits or benefits that may be derived from the frozen assets while the case remains before the court.
