The Ethics and Anti-Corruption Commission (EACC) has been cleared to continue investigating a Nairobi lawyer over allegations that he sought a Ksh10 million bribe from former Cabinet Secretary Raphael Tuju to influence a High Court judge.
🇰🇪 Breaking It Down
The High Court in Nairobi dismissed the lawyer’s petition seeking to stop the investigation and any potential prosecution over the matter.
According to court documents obtained by Kenyans.co.ke , the judge found that the lawyer had not presented sufficient evidence to justify stopping the commission’s work.
“The Petitioner has failed to demonstrate that the EACC’s probe has crossed the high threshold of malice, clear lack of factual foundation, illegality, or ultra vires action to warrant judicial interference,” stated the judgment issued on October 7.
📌 What You Need to Know
Court documents indicated that Tuju filed a complaint on March 9, alleging that a lawyer, a businessman and a deceased former High Court judge had solicited Ksh10 million from him.
The money was allegedly meant for a sitting judge in exchange for a favourable decision in a commercial dispute involving Tuju’s Dari Business Park and Entim Sidai properties.
The dispute was before the High Court’s Commercial and Tax Division over planned auctions to recover a bank loan .
The lawyer and the two other individuals were arrested during an EACC operation at a wellness facility in Karen, Nairobi, where investigators recovered Ksh1 million in specially prepared cash.
The commission said it had launched investigations after receiving the complaint and helped Tuju record conversations linked to the alleged bribery arrangement.
The lawyer denied wrongdoing, arguing that investigators had orchestrated an entrapment and violated his constitutional rights during the operation.
