The International Federation of Association Football (FIFA) has rejected the suspension of Football Kenya Federation (FKF) President Hussein Mohamed, as well as other members of the National Executive Committee (NEC).
🇰🇪 Breaking It Down
In a strongly worded letter dated May 25 obtained by Kenyans.co.ke , FIFA's Chief Member Associations Officer Elkhan Mammadov wrote directly to the FKF NEC, stating the global football body's position on the matter unmistakably clear.
According to FIFA, the suspension process did not comply with Article 41 of the FKF Constitution, which strictly governs how officials can be provisionally dismissed or suspended.
As such, the federation ruled that Mohamed's suspension, as well as those of acting Secretary General Dennis Gicheru, and nominated NEC member Abdulahi Yusuf Ibrahim were unconstitutional.
📌 What You Need to Know
“Having carefully considered the information, documentation and explanations submitted, we deem it necessary to recall the relevant provisions of the FKF Constitution governing such situations,” stated FIFA.
“FIFA therefore categorically rejects the procedure that has been followed in this matter.”
Under Article 41, any suspension must be properly proposed, placed on the agenda, communicated to NEC members, meet quorum and voting requirements, and give the affected official a fair chance to be heard.
FIFA was categorical in this facet, making it clear that the information and documentation submitted by the other NEC faction failed to demonstrate that any of these required procedural steps had actually been respected before the vote was taken.
The global football body also made clear that ordering an official to "step aside," when done as a mandatory instruction rather than a voluntary act, legally qualifies as a provisional suspension under the FKF Constitution.
“Executive Committee that were not adopted in full compliance with Article 41 and the related procedural provisions of the FKF Constitution,” adding “Actions taken outside the clearly defined statutory framework cannot produce valid legal effects within the association.”
