A city lawyer has been arraigned over an alleged Ksh37 million fake gold scam, with prosecutors accusing him of obtaining millions from a businessman by falsely claiming he could facilitate the sale of 400 kilograms of gold.
🇰🇪 Breaking It Down
The lawyer appeared before the court on Wednesday, August 5, 2026, where he was charged alongside a co-accused with obtaining money by false pretences.
According to the prosecution, the two allegedly obtained more than Ksh37 million from the businessman on different dates between May 1 and May 9, 2023, after falsely claiming they were in a position to sell him 400 kilograms of gold.
Prosecutors told the court the suspects knew the claims were false and used them to defraud the complainant.
📌 What You Need to Know
According to the DCI, the complainant transferred Ksh49,400,500 to the advocate in several instalments between November 16, 2023, and January 3, 2024, for the land transaction.
Investigators allege the advocate diverted the funds for personal use instead of completing the purchase and is expected to face charges of stealing by an agent as investigations continue.
The prosecution opposed the lawyer's release on bail, arguing that he had previously failed to attend court and that his place of residence was unknown.
State prosecutors further argued that releasing him on bail posed a flight risk because he was unlikely to attend future court proceedings.
In a separate recent case, the Directorate of Criminal Investigations (DCI) arrested a Nairobi-based advocate over allegations that he misappropriated Ksh49.4 million entrusted to him to facilitate the purchase of a parcel of land.
In the fake gold case before the court, the defence opposed the prosecution's application to deny the advocate bail, arguing that he was willing to cooperate with the judicial process and would attend all future court proceedings.
